Public Service Commission (PSC) in a rejoinder to a story headlined "Telltale evidence corruption at PSC" published in The Daily Star on May 4 said the report is false and baseless.

The rejoinder signed by PSC Deputy Secretary (administration) Moqbul Hossain claimed that the incidents of taking bribe from aspirant candidates of 27th BCS on behalf of the PSC top office bearer are imaginary, malicious, defamatory and provocative. The main claims made in the rejoinder are the following:

1) Marks of written exams are kept in the computer system in coded form and not provided to the members of the viva board.

2) The allegation of placing bribe-offering candidates' reports at certain viva board is totally baseless and false as the viva boards are formed according to the registration serial numbers of the candidates.

3) It is false that not a single viva candidate on October 12, 2006 and November 28, 2006 was successful and 64 candidates of November 12, 2006 viva board were offered job.

4) PSC authorities are surprised at The Daily Star allegation that as many as 64 successful candidates with roll numbers between 52001 - 54299 were selected under a "package deal".

5) The allegation that only nine out of 250 candidates were given pass marks on October 15, 2006 is also false.

6) It is false and fabricated that only two candidates were given pass marks on November 11 and given job in the foreign service because no viva was held on that day.

7) No candidate from Satkhira was selected for police service who appeared in viva voce on September 17, 2006.

OUR REPLY

Most leading newspapers including the Prothom Alo, Ittefaq, Jugantor, Shamokal, Amar Desh, Janakantha and The Daily Star had published reports on the irregularities of PSC, especially about leakage of question papers, which were widely available at different university dormitories. In spite of widespread media reporting and claims by examinees, the PSC held the 27th BCS examination.

Because of allegations, an intelligence agency investigated and found irregularities. Finally, the caretaker government postponed the medical test (that started on April 7) of the BCS candidates on April 18, proving the existence of serious irregularities.

Our reply to the points made in the rejoinder is as follows:

1) To prevent irregularity, the rejoinder claims that marks of written exams are kept in the computer system in coded form. But the reality is that such codes cannot prevent irregularity when senior PSC officials themselves get involved in corruption.

2) In the viva voce examination, around 5,000 candidates--many with good scores in written tests--were given bellow 40, the pass mark in viva voce. This itself is a record. The rejoinder did not deny the allegation.

We agree that viva boards were formed according to the registration serial numbers but a vast number of candidates allegedly bribed to change their viva boards and ensured their expected viva board by claiming to be sick and obtaining medical certificates to that effect.

3) The Daily Star stands corrected about the following mistake. The report mentioned that not a single viva candidate on October 12, 2006 and November 28, 2006 was successful. Instead of "not a single viva candidate" it should read "not a single viva candidate in the general cadre".

4) The PSC sources confirmed that different "package deals" were responsible for the irregularities of the BCS. The 64 successful candidates of November 12, 2006 were allegedly one of such deals, which becomes obvious when compared with other viva voce days.

5) The report mistakenly mentioned a viva voce date on November 11, 2006. The correct date is September 25, 2006 in which three candidates were offered jobs in the foreign service.

6) A total of nine engineering students, along with other successful candidates, passed on October 15, 2006. We regret this error.

7) Our report mentioned four examples of bribery. The protests only the Satkhira example, but remains silent about the other three. We have names of all the four candidates involved but did not publish their names to prevent their personal humiliation.

The Daily Star stands by its report in general, except for some errors in mentioning specific dates. We however agree that some words used in our report is very sweeping and give the impression that majority of the examinees adopted unfair means. This impression is not correct, and as such we regret that such sweeping words were used.

The new Chairman of PSC Dr Sa'dat Hossain said on CSB news that,he will consult with four groups:

1)The qualified candidates,
2)The unqualified candidates,
3)The reporters & journalist of newspapers, and
4)The PSC officers & staffs

So, we all the qualified candidates should follow up the fact & should maintain communication with the PSC and ministry of establishment for getting quick response to recover our mental tension & stress.

HC rule on PSC why viva voce was cancelled

The High Court yesterday issued a rule upon the Public Service Commission to explain why its decision canceling the viva voce results of the 27th Bangladesh Civil Service examination should not be declared "illegal".

It also asked the PSC to show cause why its decision on holding a fresh viva exam should not be declared "without lawful authority".

After hearing three similar writ petitions, filed by a group of aggrieved selected candidates, an HC division bench comprising Justice Shah Abu Nayeem Mominur Rahman and Justice Zubayer Rahman Chowdhury passed the orders.

The rule is returnable in three weeks, says the court order.

The court in its orders, however, did not interfere in holding fresh viva voce examination that begins on July 29. But the court restrained the PSC from publication of the results until the case is disposed of.

On May 30, the present caretaker government cancelled the viva voce of the 27th Bangladesh Civil Service examinations in response to widespread allegations of nepotism and corruption in the recruitment process.

Barrister Rafiqul Huq, Dr M Zahir and Abdur Razzak appeared for the petitioners.

The results of the 27th BCS examinations are not likely to be published within the coming year, the Public Service Commission chairman said Thursday.

"It will not be possible for us to publish the results of the 27th BCS exams in the next one year as there are so many cases against the commission pending trial," PSC boss Saadat Hussain said.

"We are not certain when the cases will be resolved," he said, adding that the cases are disrupting the regular activities of the commission.

"The viva voce of the current BCS exam will be finished in May, but the PSC will have to delay publishing the results," the chairman said.

Actually PSC thought BCS as a exam of drama.

However they should know it is a heart and soul try of three years every successful candidates.

So the will remember this chapter of struggle throughout his whole life.

The interim govt must settle 27th BCS recruitment process within their tenure. Thousands of innocent and talented lives can not be ruined by the decesion made by the govt.
They cancelled the viva result to restore transparency and now its their RESPONSIBILITY to recruit 27TH BCS cadres.

Definitely, Its their responsibility to finalize the recruitment process of 27th BCS. They also should be more responsible on their word on media.Sometimes they are saying it will take "MORE THEN A YEAR TO PUBLISH RESULT(BRAC UNIV)", On the other hand "more then 3 monthb will require to publish the result at PENINSULA,Chittagong.Its not possible to implement the revive quata system on 27th BCS it will be implemeted on from 28th.On the other hand At Peninsula same person saying The revive quata system will be implemented on 27th BCS.

plz. stop staging drama regarding 27th bcs. give our job back very immediately otherwise it would be a uncivilized act played by a civilized authirity. we proved our talents with the new syllabus and successfully qualifued so it must be a great mistake of the authority if we, the successful candidate, are deprived to join very immediately. moreover a single "5-20 minute's" viva is not enough to comment as a whole. if we don't get the justice, of course almighty allah will give exemplary punishment to the concerned authority who are responsible for our misery. is our time not valuable to those who are playing drama. the must be accounted. we pray to tha almighty allah for our right.

ABOUT THE BCS TELECOM CADRE

BTTB is going to be PLC. According to The Daily Jugantor of 05-05-08 BCS(telecom) will also be vanished. Now what will be to the selected candidates of BCS(telecom) at 27th BCS & The post of 28th BCS? "PSC" please please clear it. It has still time revive the circuler of 28th BCS.

The restrictions on Public Service Commission (PSC) publishing the 27th Bangladesh Civil Service (BCS) examinations have gone as the High Court yesterday rejected three writ petitions challenging the legality of the PSC decision cancelling the results of its viva voce.

The PSC took fresh viva voce for the 27th BCS exams after canceling the previous viva, prompting the aggrieved candidates to file writ petitions. As a result, the PSC could not publish the final results of the much-talked-about 27th BCS exams.

Now it will take about two months to publish the results, PSC Exam Controller AEM Nesar Uddin told The Daily Star.

An HC bench of Justice Md Abdur Rashid and Justice Md Ashfaqul Islam yesterday rejected the petition, saying that the court would not interfere in the activities of PSC.

Counsels for the petitioners said the court verdict means that the decision of PSC would remain valid and there is no bar to publishing the results of the fresh viva voce.

On June 12, 2007, the PSC cancelled the viva voce of the 27th BCS exams and decided to hold fresh viva of the successful candidates of the written examinations following a request from the caretaker government.

The government also issued a notification saying that the decision was taken after reviewing newspaper reports and various allegations about the 27th BCS examinations in order to restore confidence in public mind and establish transparency in the recruiting process for public jobs.

Some 12 successful candidates, including Toufiqul Islam, filed three similar writ petitions with the HC challenging the government decision cancelling the results of the viva voce.

The petitioners stated in the petitions that all the tests, including preliminary, written and viva voce, of the 27th BCS were held according to due process of law and the government could not ask the PSC to cancel the results.

Upon the petitions, an HC bench of Justice Shah Abu Nayeem Mominur Rahman and Justice Zubayer Rahman Chowdhury issued a rule upon the PSC and the government on July 22, 2007 to explain why the decision should not be declared "illegal".

It also asked the PSC to show cause why its decision on fresh viva voce should not be declared "without lawful authority".

The court in its order did not interfere in holding fresh viva voce that began on July 29. But the court asked the PSC not to publish the results until the case is disposed of.

The HC recently started the final hearing of the writ petitions and delivered the verdict yesterday.

Some 16,342 candidates attended the viva voce held between September and December 2006.

Dr M Zahir, Barrister Abdur Razzak, Advocate Mostaque Ahmed, Advocate Ahsanul Karim and advocate Shah Mohammad Ejajur Rahman appeared for the petitioners while Assistant Attorney General (AAG) Zafar Imam argued for the government.
